Dear Employer

I refer to your letter dated ________________ relating to mandatory COVID-19 vaccination.

Before I make a decision in respect of this notice, I would like to clarify certain matters.

Would you please advise as to which legislative instrument you draw your authority from, and where there has been a federal government law passed which would require me to have the COVID-19 vaccination? If such a law has been made, could `I please have a copy of the royal assent, a proclamation certificate verifying its authenticity and a commencement date?

Section 2.1.3 of the Australian Immunisation Handbook (page 26) states that free and informed consent must be given “voluntarily in the absence of undue pressure, coercion and manipulation”.

This requirement is a clear breach of the code of conduct for good medical practice and the International Covenant for Economic, Cultural and Social Rights (“ICESCR”) which prohibits discriminatory welfare policies and the removal of autonomy over our own bodies.

It is also in breach of the Victorian Charter of Human Rights and Responsibilities 2016 (“the Charter”) and, in particular section 10(c), which states that “[a] person must not be subjected to medical or scientific experimentation or treatment without his or her full, free and informed consent.” In addition, section 14(2) states that “[a] person must not be coerced or restrained in a way that limits his or her freedom to have or adopt a religion or belief in worship, observance, practice of teaching.” Furthermore, section 8(2) provides that “[e]very person has the right to enjoy his or her human rights without discrimination”. This vaccination would represent medical experimentation without my “free” consent (as it would be only administered under coercion to enable me to retain my employment), would be contrary to my observance of my religious beliefs and requiring my vaccination would, therefore be discriminatory.

I certainly do not wish to ever feel that I have passed on any communicable disease to a third party; however, I need to balance that with the fact that I have concerns about the safety of the COVID-19 vaccine.

On any objective view, the COVID-19 vaccine has been rushed, has not been subject to animal testing, has not been subject to sufficient testing not completely safe and comes with many severe risks.

It is noted that in relation to the COVID-19 vaccines, it is understood that the vaccine insert for these vaccines will only be issued when they have been approved by the US Food and Drug Administration and the Centers for Disease Control (“CDC”), despite the fact that, as at December 2020, the vaccines have already been administered to individuals in the US and the UK under emergency use authorisation.

Given the experimental new technology used in this vaccine and the rushed nature of the clinical trials, no long-term safety studies of the vaccine have been undertaken. Therefore, vaccination amounts to medical experimentation. The Nuremberg Code confirms that voluntary consent to medical experimentation is absolutely essential. In addition, potential serious side effects of the COVID-19 vaccines have been listed by the CDC in a draft working list which include :

• Guillain-Barré syndrome
• Acute disseminated encephalomyelitis
• Transverse myelitis
• Encephalities/myelitis/encephalomyelitis/meningoencephalities/meningitis/ encepholapathy
• Convulsions/seizures
• Stroke
• Narcolepsy and cataplexy
• Anaphylaxis
• Acute myocardial infarction
• Myocarditis/pericarditis
• Autoimmune disease
• Death
• Pregnancy and birth outcomes
• Other acute demyelinating diseases
• Non-anaphylactic allergic reactions
• Thrombocytopenia
• Disseminated intravascular coagulation
• Venous thromboembolism
• Arthritis and arthralgia/joint pain
• Kawasaki disease
• Multisystem inflammatory syndrome in children
• Vaccine enhanced disease

Moreover, others will be protected from COVID-19 arising from their own vaccination, which you maintain is safe and highly effective. Therefore, there is no need for me to have this vaccination to protect others. COVID-19 gives rise to symptoms and there is no evidence which supports asymptomatic transmission. Indeed, the PCR tests which are administered were not intended to be diagnostic tools and are known to give substantial false positives.
If you claim that asymptomatic transmission occurs, please provide me with full scientific papers and analysis which irrefutably proves this. Therefore, should I be infected with it, it is highly unlikely that I would pass it to others given that I would have symptoms.

I am aware of no compelling evidence that receiving a COVID-19 vaccine makes someone less likely to transmit it to others. Even the World Health Organisation conceded in December 2020 that they cannot confirm that the COVID-19 vaccine will prevent individuals from being infected with and transmitting the coronavirus. If you have any evidence to the contrary, please provide it.

Therefore, there can be no additional danger arising from those who are not vaccinated. In Australia, we are protected by both statute and common law that allows us to choose whether to have an invasive medical procedure and I should not be subjected to coercion. My job should certainly not be at risk as appears to be the case at the present time.

If it is to be the case that my employment has now become conditional upon submitting to COVID-19 vaccine, given that full immunity has been given to the manufacturer of the vaccine, are you prepared to fully indemnity myself and my family for financial losses in the event that I suffer any adverse reaction to the vaccine?

I am fully aware that you are simply following the directions from the Government and I appreciate the position you are in must be difficult, however, as a legally registered organisation, it is your responsibility to ensure that directions or policies you enforce are legal, lawful and do not take away our individual rights that are in fact protected according to our Constitution and the Charter.

This new requirement for vaccination is unlawful and should you choose to terminate my employment on the grounds of refusing the COVID-19 vaccine, it gives me the right to take this further legally as it goes against my Constitutional rights, my human rights and my employment rights and amounts to constructive dismissal.

Please take a moment to make yourself familiar with the consequences of facility to comply with our Constitution, the Charter and hindering my rights.

Take Notice that any breach of this Notice by any person may attract a breach of section 83.4 of the Commonwealth Criminal Code Act 1995, which may lead to prosecution in a court exercising Federal Jurisdiction.
